The rise of autonomous vehicles like the Tesla Cybercab — which has no steering wheel or brake pedals — is pushing regulators at the US NHTSA to revisit decades-old crash safety rules built around the assumption that occupants sit upright. Reclined passengers face higher injury risk, yet current crash test dummies physically cannot slouch.

When Tesla's Cybercab launched its Robotaxi service earlier this month, passengers discovered the front seat reclines far enough to sleep. Tesla's own rider guide warns against going past 35 degrees from vertical — and safety researchers back that caution. According to US federal data, at least 42 traffic fatalities over the past decade involved occupants with reclined seat backs, and the IIHS's Becky Mueller says that figure is almost certainly an undercount: crash scenes are chaotic, and responders rarely document seating position before extraction.

The core problem is structural. Current vehicle safety standards assume occupants are upright, seatbelts crossing the hip, feet on the floor. Airbag systems are tuned for that posture. Crash test dummies have rigid pelvises — they literally cannot slouch. Revising these standards means funding new studies, analyzing results, and surviving a lengthy public comment process, a cycle that can easily take years.

NHTSA told WIRED it chose reclined occupants as "a starting point for automated vehicle occupant safety," acknowledging that when driving is no longer required, riders will naturally shift posture. Mueller frames it more bluntly: AVs are finally forcing regulators to reopen rules that have been left untouched largely because the revision process is so cumbersome.
